OUR ROLE — EDUCATION, CLARITY AND OPTIONS
The purpose of MCA Rescue is to help business owners obtain greater clarity concerning their financial circumstances and understand potential options that may be available to them.
Depending upon the circumstances, those options may include:
Evaluating existing business debt and cash-flow obligations;
Exploring business funding or refinancing opportunities;
Understanding potential options when merchant cash advance (“MCA”) obligations have become distressed;
Improving personal and business credit profiles through education and coaching;
Identifying opportunities to reduce business expenses;
Evaluating certain tax-related considerations that may warrant consultation with a qualified tax professional;
Evaluating employee-benefit and health-insurance expenses;
Evaluating business cash reserves, savings strategies, and financial efficiency; and
Receiving introductions to independent professionals or companies capable of providing services outside MCA Rescue's scope.
MCA Rescue may explain how various strategies, products, services, or processes generally work. Such explanations are educational and informational and are not a substitute for individualized legal, tax, accounting, credit-repair, insurance, investment, or other licensed professional advice.
MCA RESCUE DOES NOT SETTLE OR NEGOTIATE DEBT
MCA Rescue does not provide debt settlement, debt adjustment, or debt negotiation services.
MCA Rescue does not negotiate with merchant cash advance companies, creditors, lenders, collection agencies, or their representatives on behalf of clients.
MCA Rescue does not determine settlement amounts, make settlement offers, accept settlement offers, receive or hold settlement funds, make payments to creditors, or control the negotiation process.
When a business owner is experiencing financial distress involving merchant cash advances or other commercial obligations, MCA Rescue may explain that consultation with qualified legal counsel is one potential option and may provide an introduction to an independent attorney or law firm experienced in such matters.
Any attorney or law firm to whom a client is introduced is an independent third party.
The decision to consult with that firm is entirely the client's decision. If the client chooses to proceed, the client must independently review, understand, and accept the attorney or law firm's engagement agreement, fees, terms, conditions, disclosures, and advice.
Any attorney-client relationship exists solely between the client and the attorney or law firm engaged by the client.
MCA Rescue is not a party to that attorney-client relationship and does not direct, supervise, control, or participate in legal representation, negotiations, or settlements.
WE DO NOT ADVISE CLIENTS TO STOP MAKING PAYMENTS
MCA Rescue does not advise, instruct, encourage, or recommend that a business owner stop making payments, cancel payments, block ACH withdrawals, breach a financing agreement, default on an obligation, move or conceal assets, or otherwise violate a contractual or legal obligation.
Certain legal or restructuring options may become relevant when a business or account is already experiencing financial distress, delinquency, missed payments, default, or an imminent inability to meet existing obligations.
Explaining that such circumstances may affect the availability or appropriateness of certain options is not a recommendation that a business intentionally create those circumstances.
Whether a business should continue, modify, suspend, or otherwise address payments under an existing agreement is a decision the business owner should make after reviewing the applicable contract and, where appropriate, obtaining advice from qualified legal counsel.

INDEPENDENT ATTORNEYS AND PROFESSIONALS

MCA Rescue does not control the professional judgment, recommendations, negotiations, legal strategy, pricing, performance, or services of an independent attorney, law firm, credit-repair company, lender, funding provider, tax professional, insurance professional, accountant, or other provider.
Clients are responsible for independently evaluating a provider and reviewing that provider's agreements, disclosures, fees, qualifications, and terms before retaining or purchasing services from that provider.
REFERRAL AND AFFILIATE COMPENSATION
Transparency is important to us.
MCA Rescue, its operating company, Sebastien Boyer – The Approved Guy, or affiliated entities may receive compensation from certain third-party providers when a client is introduced to or obtains products or services from those providers.
Depending upon the relationship and applicable law, this may include referral compensation, brokerage compensation, commissions, affiliate compensation, marketing compensation, or other fees.
This may include compensation from certain business funding providers or lenders and compensation associated with referrals to certain independent service providers, including law firms where such arrangements are lawful and ethically permissible.
The existence of a compensation relationship does not increase or guarantee the likelihood of approval, settlement, funding, savings, or any particular result.
Clients remain free to decline any introduction and seek another provider of their choosing.
Nothing on this website should be interpreted as guaranteeing that any particular provider is appropriate for a client's individual circumstances.
BUSINESS FUNDING
MCA Rescue is not a bank and does not lend its own money.
MCA Rescue does not represent itself as the lender providing financing.
MCA Rescue may act as a consultant, coach, broker, affiliate, or referral source in helping businesses understand and explore potential funding opportunities.
Any financing is provided by an independent bank, lender, funding company, or other provider and is subject to that provider's underwriting requirements, approval standards, rates, fees, documentation requirements, terms, and conditions.
There is no guarantee that a client will qualify for financing or receive any particular amount, rate, term, or approval.
MCA Rescue or its affiliates may receive compensation from a lender, funding provider, or other third party in connection with certain successfully completed transactions where permitted by law.
CONSULTING AND COACHING FEES
In certain circumstances, MCA Rescue may charge a client consulting, coaching, assessment, advisory, or other service fees for MCA Rescue's own time and services.
Unless expressly stated otherwise in a written agreement, such fees compensate MCA Rescue for the services actually provided and are not contingent upon or a guarantee of:
Obtaining a loan or financing;
Receiving a particular funding amount;
Obtaining a debt settlement;
Reducing an MCA obligation;
Improving a credit score by a particular amount;
Achieving particular tax savings;
Reducing expenses by a particular amount; or
Achieving any other specific financial outcome.
Payment of a consulting or coaching fee does not guarantee that a client's financial circumstances can or will be corrected.
CREDIT EDUCATION AND CREDIT REPAIR
MCA Rescue may provide education and coaching regarding personal and business credit, including helping clients understand factors that may affect creditworthiness and steps that may help them build stronger credit profiles.
MCA Rescue does not itself provide credit-repair services or guarantee that negative information can be removed from a credit report or that a particular credit score can be achieved.
Where appropriate, MCA Rescue may introduce clients to an independent third-party credit-repair provider.
Any credit-repair services are provided solely by that independent company pursuant to its own agreement, disclosures, fees, policies, and applicable law.
No person or company can lawfully guarantee that accurate and verifiable negative information will be removed from a credit report merely because a consumer disputes it.
TAX, EMPLOYEE BENEFITS AND OTHER FINANCIAL MATTERS
As part of a broader financial review, MCA Rescue may ask questions concerning taxes, employee benefits, health-insurance costs, cash reserves, savings, financing, credit, and other areas that affect business cash flow.
These questions are intended to identify areas that may warrant further evaluation.
Unless separately and expressly provided by an appropriately licensed or qualified professional, MCA Rescue does not provide legal, tax, accounting, investment, securities, or other professional advice requiring a license or professional designation.
Clients should consult qualified professionals before making decisions requiring individualized professional advice.
NO GUARANTEED RESULTS
MCA Rescue does not guarantee financial recovery or any particular result.
There is no guarantee that:
A business will qualify for financing;
A creditor or MCA provider will negotiate;
An attorney will accept a matter;
A settlement will occur;
An obligation will be reduced;
Payments will decrease;
Collection activity will stop;
Litigation will be prevented;
A credit score will increase;
Negative credit information will be removed;
Taxes or expenses will decrease;
Cash flow will improve by a particular amount; or
A business will successfully recover from financial distress.

Depending upon the applicable contracts and circumstances, these may include collection activity, additional fees, defaults, litigation, judgments, liens, UCC-related actions, disruption of banking relationships, damage to personal or business credit, difficulty obtaining future financing, and other consequences.

If bankruptcy may be relevant to a client's circumstances, the client should consult a qualified bankruptcy attorney to understand available options and consequences.
CALL RECORDING AND COMMUNICATIONS
Communications with MCA Rescue, including telephone calls, may be monitored or recorded for quality assurance, training, documentation, security, dispute resolution, and compliance purposes.
Recording will be conducted subject to applicable law, including obtaining consent where required.
SERVICES MAY VARY BY JURISDICTION
Products, professional services, funding programs, referrals, and other opportunities discussed through MCA Rescue may not be available in every jurisdiction.
Availability, eligibility requirements, laws, underwriting standards, and third-party programs may change without notice.
